By using the Online Art Gallery, you are agreeing to the Terms of Use as well as the additional guidelines and terms set forth below.

1. This website is intended as an online gallery for users to upload an image of their original artwork. It is not intended for digitally created artwork, so please do not attempt to upload any such images.

2. By uploading artwork, each user represents that the artwork is entrant's own original creation, created solely by entrant, or that the entrant has the rights required to publish the content on the Online Art Gallery, and that the artwork does not infringe third party rights and is suitable for publication (i.e., not indecent or obscene).

3. Artwork uploaded to the Online Art Gallery must not be offensive, indecent or obscene, and cannot defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's or third party's personal or proprietary rights.

4. By uploading artwork, each user grants Prismacolor, Sanford, L.P. and their affiliated entities the royalty-free right to publish and display the Artwork within the Prismacolor Online Art Gallery. Prismacolor cannot prevent or be responsible for the use or abuse of the artwork by other visitors to the Online Art Gallery. The Online Art Gallery is made available on an AS-IS basis and may be changed or removed by Prismacolor at any time. Each user hereby waives and releases Prismacolor, Sanford, L.P., and their respective affiliates, successors and assigns from and against any claims, damages or liability arising out of or relating to their artwork or the Online Art Gallery.
